There is no life guard, private pool care with small children needed. Only soft ambient music allowed throughout the day by the pool/patio or Sports Court, Quiet time after 10pm -------------------------------------------------------------------------------------------- License Agreement – Vista Grande This Short-Term License Agreement (the “Agreement”) is made by and between Arturo Dominguez (“Homeowner”) and whoever books the property (“Guest”) as of the date last set forth on the booking. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows: Property. The property is located at: 10104 Lazy J Tr, Helotes TX 78023 The property is furnished and includes linens, towels, and kitchen equipment. 3. Maximum Occupancy: The maximum number of overnight guests is limited to 16 persons. There is an additional charge per night per overnight guest over 10 persons, up to 16 persons max. The Guest may invite up to ten additional persons onto the property for a quiet social gathering WITH PRIOR APPROVAL ONLY, but not for an overnight stay. Any exceptions MUST be pre-approved in writing. 4. Term of the license agreement: The term shall start and end on the dates and times set forth in the reservation on the booking site. 5. Terms and Conditions: Guest agrees to abide by the Terms and Conditions attached as Exhibit A at all times while at the property and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while at the property. 6. Access: Guest shall allow Homeowner access to the property for purposes of repair and inspection, provided that Homeowner gives advanced notice, except in cases of emergency. Homeowner shall exercise this right of access in a reasonable manner. 7. Rate and Cancellation Policy: Guest agrees to the rates, fees, and cancellation policy provided on the booking website at the time of booking. 9. Amenities: The spa poses a risk to any and all guests on the property. Guest understands and acknowledges that the use of other equipment (including recreational equipment) and facilities provided by Homeowner, and participation in outdoor activities, involves risks including, but not limited to the following: risk of property damage, bodily injury, including, but not limited to permanent disability, paralysis, and possibly death. These risks may result from a variety of circumstances including, but not limited to, the use or misuse of the equipment or facilities, from the activity itself, from the acts of myself or others, or from the unavailability of emergency medical care. 10. Hot Tub (Spa): Hot tubs and spas that are equipped with heaters are not guaranteed to sustain any constant temperature. Please note that pool temperatures vary due to certain circumstances, including but not limited to: wind, rain, low temperatures, storms, sand, fungus or algae caused by extreme temperatures, excessive use or contamination by Guests. There shall be no compensation for any loss of use. Any damage to the spa caused by Guest and any other persons on Property during the agreed upon License Period, including but not limited to: broken glass or other items introduced into the pool, contamination of the water, damage to the automatic cleaners or equipment, or excessive loss of water will result in charges to the Guest for correction of the problem. Spa Shut Off: When and if the spa is used, Guest will be responsible for turning on and shutting off the spa. Failure to shut off the heater for the Spa may result in an excessive utility bill, which may be charged to the Guest’s SIC Deposit. As the Guest, by booking this home you agree to the following: "I am aware that my stay at the Property involves risks that may result in serious bodily injury and/or death. Some of the risks include, but are not limited to, drowning, slips, trips, falls, cuts, adverse weather conditions, the acts or omissions of guests or visitors on the Property during my stay, and the condition of the Property. In consideration of being permitted to rent and stay at the Property, I agree on my own behalf and on behalf of my family and guests and on behalf of my children and all minors in my care, custody or control (hereafter also included in “I” or “my”) to assume full responsibility for the risks identified herein and those risks not specifically identified. I HEREBY RELEASE HOMEOWNER FROM LIABILITY AND WAIVE ANY AND ALL CLAIMS THAT I HAVE OR MAY HAVE IN THE FUTURE AGAINST HOMEOWNER. I AGREE TO FULLY AND FOREVER RELEASE AND DISCHARGE, and not to sue Homeowner for any injuries or damages, including property damage that may result from arise out of or be related in any way to my rental and stay at the Property. If any portion of this Document shall be declared unenforceable for any reason, the unenforceable portion shall be considered severed from the Document and the remainder of the Document shall not be affected and shall be valid and enforceable to the fullest extent permitted by law. By booking this property, I assume all risk, and take full responsibility and waive any claims of personal injury, death or damage to personal property associated with activities and events during or related to the stay in the subject property. I ACKNOWLEDGE THAT I HAVE READ THIS ENTIRE DOCUMENT AND THAT I UNDERSTAND ITS TERMS AND AGREE TO BE BOUND BY THEM. I UNDERSTAND THAT THE EFFECT OF THIS DOCUMENT IS THAT I AM RELEASING LIABILITY AND WAIVING MY RIGHT TO SUE RELEASEES AND I AM ASSUMING RISK FOR MATTERS RESULTING FROM, ARISING OUT OF OR RELATING IN ANY WAY TO MY RENTAL AND STAY AT THE PROPERTY, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, DEATH AND PROPERTY DAMAGE. EXHIBIT A TERMS & CONDITIONS 1. SMOKING: Smoking is NOT allowed in the home. 2. GUEST PROMISES: The person signing this contract will be present during the entire license period and is at least 25 years of age. 3. NO EVENTS of any kind are allowed on the property. This is NOT a hotel and is NOT an event center. Guest agrees to NOT have any type of event at the house, including (but not limited to) Wedding, Stag or Stagette party, bachelor party, bachelorette party, or ANY OTHER event. 4. QUIET TIME: 10 PM until 8 AM is “quiet time” every evening. All noise including loud talking, music and any other sounds will be moved indoors during the hours designated as “quiet time”. 5. GUEST PROMISES: 1) Not to act in a loud, boisterous, unruly or thoughtless manner or disturb the rights of neighbors to peace and quiet, or allow his/her guests to do so; 2) to use the home only as a private residence, and not to engage in any activity or allow any condition that is illegal or dangerous or which would cause a cancellation, restriction, or increase in premium in Homeowner’s insurance or allow his/her guests to do so; 6. GUEST PROMISES: 1) Not to damage or misuse the home and contents provided by Homeowner or allow his/her guests to do so; that when Guest moves out, the home will be left in good condition, except ordinary wear and tear. Guest agrees to keep the property and all furnishings in good order and only use appliances for their intended uses. Guest shall pay for any repairs or replacement, all loss or damage to the house and its contents whenever such damage or loss is beyond normal wear and tear. 7. GUEST PROMISES: to inform Homeowner IMMEDIATELY if there are any issues with the home. Since our home is maintained strictly as a short-term rental, our guests have full access to everything pictured; every room and amenity. All closets and cabinets are available for use, with the exception of a couple that are used to store housekeeping supplies.
