House Rules

License Agreement – Casa Del Sol This Short-Term License Agreement (the “Agreement”) is made by and between Arturo Dominguez (“Homeowner”) and the person booking the property (“Guest”) as of the date of the booking completion. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows: 1. Property. The Agreement applies to the "Casa del Sol" airbnb listing. 2. The property is furnished and includes linens, towels, and kitchen equipment. 3. Maximum Occupancy: The maximum number of overnight guests is limited to 12 persons. Only those persons listed in the Guest Party above may occupy the property overnight. The Guest may not invite additional persons onto the property without prior approval. 4. Term of the license agreement. The license period begins the date of the booking and continues until the parties have completed all business related to the rental of the property. 5. Terms and Conditions: Guest agrees to abide by the Terms and Conditions attached as Exhibit A at all times while at the property and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while at the property. 6. Access: Guest shall allow Homeowner access to the property for purposes of repair and inspection, provided that Homeowner gives advanced notice, except in cases of emergency. Homeowner shall exercise this right of access in a reasonable manner. 7. Rental Rate and Fees Rental Rate and fees are as follows: +Nightly rate, cleaning fee, lodging tax, and any extra guest fees established on renting website at the time of booking. + any additional charges that arise due to damage to the property or furnishings; dirt or other mess requiring excessive cleaning; or any other cost incurred by Homeowner due to Guest’s stay. Optional Pool Heating adds an additional $35 per day. If the premises appear dirty or damaged upon Check-in, Guest shall inform Homeowner immediately. 8. Cancellation Policy: Guest shall abide by the cancellation policy set forth on the booking site at the time of booking. 9. Amenities: Guest understands and acknowledges that the use of equipment (including recreational equipment) and facilities provided by Homeowner, and participation in outdoor activities, involves risks including, but not limited to the following: risk of property damage, bodily injury, including, but not limited to permanent disability, paralysis, and possibly death. These risks may result from a variety of circumstances including, but not limited to, the use or misuse of the equipment or facilities, from the activity itself, from the acts of myself or others, or from the unavailability of emergency medical care. 10. Pool and/or Hot Tub (Spa): Hot tubs and pools that are equipped with heaters are not guaranteed to sustain any constant temperature. Please note that hot tub/pool temperatures vary due to certain circumstances, including but not limited to: wind, rain, low temperatures, storms, sand, fungus or algae caused by extreme temperatures, excessive use or contamination by Guests. There shall be no compensation for any loss of use. Any damage to the hot tub/pool caused by Guest and any other persons on Property during the agreed upon License Period, including but not limited to: broken glass or other items introduced into the hot tub/pool, contamination of the water, damage to the automatic cleaners or equipment, or excessive loss of water will result in charges to the Guest for correction of the problem. By booking this home, Guest agrees in totality to the following statement: "As the guest, I am aware that my stay at the Property involves risks that may result in serious bodily injury and/or death. Some of the risks include, but are not limited to, drowning, slips, trips, falls, cuts, adverse weather conditions, the acts or omissions of guests or visitors on the Property during my stay, and the condition of the Property. In consideration of being permitted to rent and stay at the Property, I agree on my own behalf and on behalf of my family and guests and on behalf of my children and all minors in my care, custody or control (hereafter also included in “I” or “my”) to assume full responsibility for the risks identified herein and those risks not specifically identified. I HEREBY RELEASE home OWNER FROM LIABILITY AND WAIVE ANY AND ALL CLAIMS THAT I HAVE OR MAY HAVE IN THE FUTURE AGAINST homeOWNER. I AGREE TO FULLY AND FOREVER RELEASE AND DISCHARGE, and not to sue Homeowner for any injuries or damages, including property damage that may result from arise out of or be related in any way to my rental and stay at the Property. If any portion of this Document shall be declared unenforceable for any reason, the unenforceable portion shall be considered severed from the Document and the remainder of the Document shall not be affected and shall be valid and enforceable to the fullest extent permitted by law. By booking this home, I assume all risk, and take full responsibility and waive any claims of personal injury, death or damage to personal property associated with activities and events during or related to the stay in the subject property. I ACKNOWLEDGE THAT I HAVE READ THIS ENTIRE DOCUMENT AND THAT I UNDERSTAND ITS TERMS AND AGREE TO BE BOUND BY THEM. I UNDERSTAND THAT THE EFFECT OF THIS DOCUMENT IS THAT I AM RELEASING LIABILITY AND WAIVING MY RIGHT TO SUE RELEASEES AND I AM ASSUMING RISK FOR MATTERS RESULTING FROM, ARISING OUT OF OR RELATING IN ANY WAY TO MY RENTAL AND STAY AT THE PROPERTY, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, DEATH AND PROPERTY DAMAGE. I ACKNOWLEDGE THAT THIS DOCUMENT APPLIES EVEN IF RELEASEES MAY BE NEGLIGENT IN WHOLE OR PART. I UNDERSTAND THAT THIS DOCUMENT APPLIES TO AND SHALL BE EFFECTIVE AND BINDING UPON ME, MY HEIRS, ASSIGNS, PERSONAL REPRESENTATIVE, ESTATE, AND ALL MEMBERS OF MY FAMILY, MINORS, AND OTHERS IN MY CARE, CUSTODY OR CONTROL." Attachment A - TERMS & CONDITIONS 1. SMOKING: Smoking is NOT allowed in the home. 2. GUEST PROMISES: The person signing this contract will be present during the entire license period anytime someone is in the home and is at least 25 years of age. 3. NO EVENTS of any kind are allowed on the property. This is NOT a hotel and is NOT an event center. Guest agrees to NOT have any type of event at the house, including (but not limited to) Birthday, Wedding, Stag or Stagette party, bachelor party, bachelorette party, or ANY OTHER event. 4. QUIET TIME: 9 PM until 8 AM is “quiet time” EVERY EVENING!! All noise including but not limited to loud talking, music and other sounds must stop during the hours designated as “quiet time”. Noise decibel monitors in the interior and exterior of the home assess sound levels and their duration, but do not record audio. 5. GUEST PROMISES: 1) Not to act in a loud, boisterous, unruly or thoughtless manner or disturb the rights of neighbors to peace and quiet, or allow his/her guests to do so; 2) to use the home only as a private residence, and not to engage in any activity or allow any condition that is illegal or dangerous or which would cause a cancellation, restriction, or increase in premium in Homeowner’s insurance or allow his/her guests to do so. 6. GUEST PROMISES: 1) Not to damage or misuse the home and content provided by Homeowner or allow his/her guests to do so; that when Guest moves out, the home will be left in good condition, except ordinary wear and tear. Guest agrees to keep the property and all furnishings in good order and only use appliances for their intended uses. Guest shall pay for any repairs or replacement, all loss or damage to the house and its contents whenever such damage or loss is beyond normal wear and tear. 7. Another wonderful stay at this iconic property. Definitely the best in show for Laredo - likely the only place we actually look forward to staying with our 1 year old in tow. Great communication from Arturo and a super accommodating stay all around.
